Terms of service

1. About us and these terms

1.1 Who we are. cpcclubsport.com is operated by Wedmore Performance Ltd, trading as CPC Clubsport ("we", "us", "our"). We are a company registered in England and Wales under company number 16693091. Our registered office is at Middle Moor Farm, Wedmore, BS28 4JE.

1.2 How to contact us. Email us at sales@cpcclubsport.com. We trade online only. We do not have a shop or trade counter open to the public, and orders cannot be collected unless we agree this with you in writing beforehand.

1.3 What these terms cover. These terms apply to your use of our website and to every order you place with us. Please read them before you order and keep a copy. By placing an order you agree to them.

1.4 Consumers and business customers. You are a "consumer" if you are an individual buying wholly or mainly for personal use, outside your trade, business, craft or profession. Everyone else, including garages, tuners, race teams and resellers, is a "business customer". Where a term applies to only one group, we say so.

1.5 Other policies. These terms should be read with our Privacy Policy and Refund Policy, which are available on our website.

1.6 Age. You must be 18 or over to place an order.

1.7 Language. These terms and all contracts between us are in English only.

2. Using our website

2.1 Permitted use. You may use our website to browse and buy products for lawful purposes. You must not:

  • introduce viruses or other harmful code, or try to gain unauthorised access to the website or its servers;
  • use automated tools to scrape, copy or extract content, pricing or product data;
  • place false, speculative or fraudulent orders; or
  • use the website in any way that breaks the law or interferes with other users.

2.2 Your account. If you create an account, keep your login details confidential. You are responsible for activity on your account. Tell us straight away if you think someone else has used it.

2.3 Availability. We work to keep the website available and accurate, but we do not promise it will be uninterrupted or free of errors. We may suspend, withdraw or change any part of it without notice.

2.4 Technical content. Fitment notes, guides and other technical content on our website, social media and emails are general information. They are not a substitute for advice from a qualified technician who has inspected your vehicle.

2.5 Recommendations. If you ask us to recommend a part, we rely on the vehicle details and intended use you give us. You are responsible for making sure that information is complete and accurate.

2.6 Third-party services and links. Our website is hosted by Shopify and payments are processed by third-party payment providers. We do not store your full card details. Links to other websites are provided for convenience only; we are not responsible for their content.

3. Products, fitment and compatibility

3.1 Descriptions and images. We take care to describe our products accurately. Images are for illustration; colour, finish and packaging may differ slightly from what you receive. Manufacturers sometimes revise specifications or supersede part numbers without notice. Where a part has been superseded, we may supply the manufacturer's direct replacement.

3.2 Checking fitment. Performance parts are often specific to a model, production date, engine or factory option. Before ordering, check the part is correct for your vehicle using the part number and your chassis code or VIN. If you are unsure, email us your VIN before you order and we will help.

3.3 Before you fit anything. Inspect each part and trial-fit it before you paint, coat, modify or install it. Section 9 explains how fitting or altering a part affects your refund if you return it.

3.4 Professional installation. Many of our products are safety-critical, including brakes, suspension, wheels, seats and harnesses. They should be fitted by a suitably qualified technician, following the manufacturer's instructions and torque settings. We do not provide fitting services and are not responsible for the work of any installer.

3.5 Effect on your vehicle. Performance parts can change how your vehicle handles, brakes, sounds and performs. Some need supporting modifications, geometry set-up or software calibration to work correctly. Arranging this is your responsibility.

3.6 Genuine and aftermarket parts. Parts described as "Genuine BMW" are original parts supplied through the BMW dealer network. All other parts are made by the manufacturer named in the listing.

3.7 Availability. Stock levels shown on the website are a guide. A product is not reserved for you until we accept your order under section 4.

4. Orders and when the contract is formed

4.1 Placing an order. Follow the checkout steps and check your order carefully before you submit it. Your order is an offer to buy the products from us on these terms.

4.2 Acknowledgement. We will email you to acknowledge your order. This email does not mean we have accepted it.

4.3 Acceptance. A contract is formed when we email you to confirm your order has been dispatched. For special-order parts, it is formed when we confirm in writing that we have placed the order with our supplier (see section 7). If we send your order in parts, each dispatch is a separate contract.

4.4 If we cannot accept your order. We may decline an order, for example because the product is unavailable, payment was not authorised, there is an error in the price or description, we cannot deliver to your address, or we suspect fraud. If we decline, we will tell you and refund any payment taken.

4.5 Your details. You must give us accurate contact, billing and delivery details. We are not responsible for delay or loss caused by incorrect details.

4.6 Changing or cancelling before dispatch. Contact us as soon as possible if you need to change or cancel an order. We will do our best to help, but cannot guarantee changes once an order is being processed. This does not affect a consumer's right to cancel under section 8.

5. Prices and payment

5.1 Prices. Prices are shown in pounds sterling and are the full price of the products. We are not currently registered for VAT, so no VAT is added. Delivery charges are shown at checkout before you pay.

5.2 Orders delivered outside the UK. Prices do not include import duties, local taxes or customs clearance fees charged in the destination country. Section 6 explains who pays these.

5.3 Price changes. We may change prices at any time. A change will not affect an order we have already accepted, except as set out in clause 5.4.

5.4 Pricing errors. Despite our best efforts, a product may occasionally be listed at the wrong price. If the error is obvious and you could reasonably have recognised it, we are not bound to supply at that price. We will contact you so you can choose to pay the correct price or cancel for a full refund.

5.5 Payment. We accept the payment methods shown at checkout. Payment is taken when you place your order. If you pay using a third-party finance or instalment provider, that provider's terms also apply.

5.6 Discount codes. Discount codes have no cash value, cannot be combined unless we say so, and may be withdrawn at any time before we accept your order.

5.7 Ownership. You own the products once we have received payment in full.

5.8 Business customers. If you are a business customer, you must pay all amounts in full without set-off, counterclaim or deduction.

6. Delivery

6.1 Where we deliver. We deliver within the UK and to the international destinations offered at checkout. Some products cannot be sent to some countries because of carrier restrictions (for example on oils and fluids), size limits or local law.

6.2 Timescales. Delivery times shown on the website or at checkout are estimates. We will deliver within 30 days of the day after we accept your order, unless we agree a different period with you, such as the lead time quoted for a special-order part.

6.3 Delays. If delivery is delayed, we will tell you as soon as we can. If you are a consumer and we miss the delivery period, you may set a new reasonable deadline and cancel the affected items for a full refund if we miss that too. You may cancel straight away if you told us before ordering that delivery by a particular date was essential. For business customers, delivery dates are estimates only and time is not of the essence.

6.4 When delivery happens. Delivery is complete when the products are delivered to the address you gave us, or handed to a carrier that you arranged. The products are your responsibility from that point.

6.5 Failed delivery. Many orders need a signature. If nobody is available and the products are returned to us, we may charge the reasonable cost of redelivery. If we cannot rearrange delivery after reasonable attempts to contact you, we may cancel the order and refund you less our reasonable delivery and return costs.

6.6 Checking your delivery. Please inspect your order when it arrives and tell us within 48 hours, with photos, if anything is damaged or missing. This helps us claim from the carrier. If you are a consumer, it does not affect your legal rights. If you are a business customer, you must notify us within 3 working days of delivery, after which the products are treated as accepted.

6.7 Import duties and taxes. For deliveries outside the UK, you are the importer. You are responsible for any import duties, local taxes and customs or carrier clearance fees. We have no control over these charges and cannot predict them. Please check with your local customs authority before ordering.

6.8 Unpaid duties and refused parcels. If a parcel is returned to us because duties were not paid or delivery was refused, we may deduct our reasonable carrier return costs, and any charges levied on us, from your refund to the extent the law allows.

6.9 Local rules. If you order from outside the UK, you are responsible for making sure the products can lawfully be imported into and used in your country.

6.10 Customs delays. International deliveries may be opened, inspected or delayed by customs. These delays are outside our control.

7. Special-order and made-to-order parts

7.1 What these are. A "special-order" part is a standard catalogue part that we do not hold in stock and order from the manufacturer or supplier for you. A "made-to-order" part is built, configured or finished to your specification, such as custom-valved suspension, custom-length brake lines or seats trimmed to order. The listing or our quote will tell you which applies.

7.2 Lead times. Lead times come from the manufacturer and are given in good faith, but they can change. We will keep you updated.

7.3 Payment. Special-order and made-to-order parts must be paid for in full when you order, unless we agree a deposit with you in writing.

7.4 Made-to-order parts. Because these are made to your specification, they cannot be cancelled once production has started and cannot be returned unless they are faulty or not as described. The right to cancel in section 8 does not apply to them.

7.5 Special-order parts: consumers. If you are a consumer, the right to cancel in section 8 still applies to special-order parts.

7.6 Special-order parts: business customers. If you are a business customer, you cannot cancel or return a special-order part once we have placed the order with our supplier, unless it is faulty or we agree in writing. If we agree, we may pass on any supplier restocking and return charges.

7.7 If the supplier cannot supply. If a part is discontinued, becomes unavailable or its price increases before dispatch, we will tell you and you may cancel for a full refund.

8. Your right to cancel

8.1 Consumers only. If you are a consumer, you have a legal right to cancel your order within 14 days without giving a reason. We give the same right to consumers wherever in the world we deliver.

8.2 The cancellation period. The period ends 14 days after the day you, or someone you nominate other than the carrier, receive the products. If your order arrives in more than one delivery, the period runs from the day you receive the last item.

8.3 How to cancel. Tell us clearly that you want to cancel by emailing sales@cpcclubsport.com with your name, order number and the items you are cancelling. You can use the model cancellation form below, but you do not have to. You have cancelled in time if you send your message before the period ends.

8.4 When the right to cancel does not apply. You cannot cancel under this section for:

  • made-to-order parts built or finished to your specification, or clearly personalised (see section 7); or
  • products that, after delivery, have become inseparably mixed with other items, such as oil or fluid that has been poured into a vehicle.

8.5 Business customers. Business customers do not have a right to cancel under this section. We accept returns from business customers only by written agreement, and may apply a restocking charge and pass on any supplier charges.

8.6 Model cancellation form.

9. Returns and refunds

9.1 Sending products back. If you cancel under section 8, you must send the products back within 14 days of telling us. Email us first and we will confirm the return address. Returns sent without contacting us may be delayed.

9.2 Cost of returning. You pay the cost of returning products, unless they are faulty, not as described or we sent the wrong item. Courier costs for large or heavy items such as exhaust systems, wheels and seats can be significant; ask us for an estimate. We recommend a tracked and insured service, because the products are your responsibility until they reach us.

9.3 Condition. Please take reasonable care of the products while you have them. Return them unused and unfitted, in their original packaging, with all fittings, hardware and instructions.

9.4 Deductions. You may handle a product as you could in a shop to check it is what you ordered. We may reduce your refund to reflect any loss in value caused by handling beyond this. Examples include a part that has been fitted, marked, painted or modified, oils and fluids that have been opened, and missing packaging or components. Where a product cannot be resold, the deduction may be up to the full price.

9.5 Your refund. We will refund the price of the products and the cost of standard outbound delivery. We do not refund the extra cost of any express or special delivery you chose. We will refund you within 14 days of receiving the products back, or of you sending us proof that you have returned them, if earlier. We use the payment method you paid with and charge no fee.

9.6 Returns from outside the UK. We cannot refund import duties or taxes you paid to your local customs authority; you may be able to reclaim these from that authority. Please mark the parcel as returned goods. We may deduct any duties or clearance fees charged to us on a return from your refund.

9.7 Faulty products. This section covers change-of-mind returns. Section 10 explains your rights if a product is faulty or not as described.

10. Faulty products and warranties

10.1 Consumers: your legal rights. If you are a consumer, the Consumer Rights Act 2015 says products must be as described, fit for purpose and of satisfactory quality. In summary:

  • up to 30 days from delivery: if a product is faulty, you can get a refund;
  • up to 6 months: if a faulty product cannot be repaired or replaced, you are entitled to a refund in most cases;
  • up to 6 years (5 years in Scotland): if a product does not last a reasonable length of time, you may be entitled to some money back.

This is a summary only. For more detail, visit Citizens Advice. Nothing in these terms affects your legal rights. If you live outside the UK, you also keep any rights that the law of your country says cannot be removed.

10.2 Reporting a fault. Email sales@cpcclubsport.com with your order number, a description of the problem, photos or video, your vehicle details, and who fitted the part and when. We may ask you to return the part so that we or the manufacturer can inspect it. We pay the reasonable cost of returning a faulty product.

10.3 Manufacturer warranties. Many products come with a manufacturer's warranty. Its terms are set by the manufacturer and it is in addition to your legal rights. We will help you make a claim.

10.4 What is not a fault. The following are not faults:

  • fair wear and tear, including the normal wear of consumables such as brake pads, discs, fluids, clutches and bushes, which wear quickly under track use;
  • damage caused by accident, misuse, neglect, incorrect installation or set-up, or failure to follow the manufacturer's instructions;
  • fitting a part to a vehicle or application it was not specified for;
  • modification or repair by anyone other than us or the manufacturer;
  • normal characteristics of performance parts, such as brake noise and dust, a firmer ride, increased cabin noise or exhaust drone; and
  • cosmetic changes from heat or use, such as discolouration of exhausts or brake discs.

10.5 Competition use and warranties. Manufacturers often limit or exclude their warranty for parts used in competition, on track or off-road. Where they do, we cannot offer that warranty on their behalf. This does not affect a consumer's legal rights.

10.6 Fitting and related costs. We are not responsible for the cost of fitting, removal, recovery, vehicle hire or lost track time, except where the law says we are.

10.7 Business customers. If you are a business customer, products are supplied with the benefit of the manufacturer's warranty only. You must tell us about a defect in writing within 7 days of discovering it. Our only obligation is, at our choice, to repair or replace the defective product or refund its price.

11. Motorsport, track and off-road use

11.1 Intended use. Many of our products are designed for motorsport. Where a listing says "motorsport use only", "race use only", "track use only", "off-road use only" or "not road legal", the product must not be used on a public road.

11.2 Road legality. Even where a product is not marked in this way, fitting performance parts can affect whether your vehicle meets road traffic, construction and use, noise, emissions, lighting and MOT or inspection rules. Unless a listing expressly says so, we do not promise that a product is road legal in the UK or any other country. Checking this is your responsibility.

11.3 Insurance, warranty and finance. You should tell your insurer about any modification; failing to do so may invalidate your cover. Modifications may also affect your vehicle manufacturer's warranty and the terms of any finance or lease agreement.

11.4 Competition regulations. You are responsible for checking that a product meets the regulations of any championship, circuit or governing body, including homologation requirements and circuit noise limits. For date-limited homologated items such as seats and harnesses, we supply current stock and cannot guarantee a particular manufacture or expiry date unless we agree it in writing before you order.

11.5 Inspection and maintenance. Track and competition use loads components far more heavily than road use. Parts wear faster and must be inspected regularly and replaced in line with the manufacturer's guidance.

11.6 Acceptance of risk. Motorsport and track driving are inherently dangerous. By buying products for this use, you accept the risks that are inherent in that activity. This clause does not limit our liability under clause 12.1.

12. Our liability

12.1 What we never exclude. Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • defective products under the Consumer Protection Act 1987;
  • a breach of a consumer's legal rights in relation to the products; or
  • anything else that cannot be limited or excluded by law.

12.2 Consumers: foreseeable loss. If you are a consumer and we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

12.3 Consumers: no business losses. We supply products to consumers for private use. If you use them for any commercial, business or resale purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

12.4 Losses we did not cause. Subject to clause 12.1, we are not responsible for loss or damage to the extent it is caused by:

  • incorrect installation or set-up, or installation by someone who is not suitably qualified;
  • use that is contrary to the manufacturer's instructions or our written advice;
  • fitting a product to a vehicle or application it was not specified for;
  • using on a public road a product sold for motorsport or off-road use only; or
  • your not carrying out the checks described in sections 3 and 11.

12.5 Business customers. If you are a business customer then, subject to clause 12.1:

  • all terms implied by law, including those implied by sections 13 to 15 of the Sale of Goods Act 1979, are excluded to the fullest extent permitted;
  • we are not liable for loss of profit, revenue, business, contracts, goodwill or anticipated savings, for vehicle downtime, or for any indirect or consequential loss; and
  • our total liability for all claims connected with an order is limited to the price you paid for that order.

13. Intellectual property and brand names

13.1 Our content. We own or license the intellectual property in our website, including its text, photographs, graphics, logos and the CPC Clubsport name. You may view and print pages for your own use when shopping with us. You may not copy or reuse our content for commercial purposes without our written permission.

13.2 Third-party brands. BMW, M and related model names are trade marks of BMW AG. All other brand names and logos belong to their respective owners. We use them only to identify the products we sell and to describe which vehicles they fit.

13.3 Independence. CPC Clubsport is an independent retailer. We are not affiliated with, authorised by or endorsed by BMW AG or any BMW group company.

13.4 Your content. If you send us reviews, photos or videos, or tag us in them on social media, you give us a non-exclusive, royalty-free licence to use them on our website and social media. You confirm that you have the right to share them.

14. Privacy and other general terms

14.1 Privacy. We use your personal data as set out in our Privacy Policy.

14.2 Events outside our control. We are not liable for any failure or delay caused by events outside our reasonable control. Examples include manufacturer or supplier delays, carrier disruption, customs action, strikes, extreme weather, cyber incidents and government action. We will tell you if this happens. If the delay is substantial, you may cancel and receive a refund for any products not delivered.

14.3 Export controls and sanctions. We may refuse or cancel an order where supplying it would breach export control or sanctions law.

14.4 Transfer. We may transfer our rights and obligations under these terms to another organisation, and will make sure this does not affect your rights. You may transfer your rights only if we agree in writing.

14.5 Third parties. The contract is between you and us. Nobody else has the right to enforce any of its terms.

14.6 If part of these terms is invalid. Each clause operates separately. If a court decides any clause is unlawful, the rest remain in full effect.

14.7 Delay in enforcing. If we do not insist straight away that you do something these terms require, we can still require it later.

14.8 Entire agreement: business customers. If you are a business customer, these terms and our order confirmation are the entire agreement between us. You have not relied on any statement that is not set out in them.

15. Governing law, complaints and changes

15.1 Complaints. If you are unhappy with a product or our service, email sales@cpcclubsport.com. We will acknowledge your complaint promptly and try to resolve it fairly.

15.2 Governing law. These terms and any contract between us are governed by the law of England and Wales.

15.3 Consumers: where claims can be brought. If you are a consumer, you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring them in the courts there. If you live outside the UK, you keep the protection of any mandatory rules of the law of your country, and may be able to bring proceedings in your local courts.

15.4 Business customers: where claims can be brought. If you are a business customer, the courts of England and Wales have exclusive jurisdiction over any dispute.

15.5 Changes to these terms. We may update these terms from time to time. The version on our website when you place an order is the one that applies to that order.
